Terms & Conditions – Lush House

These Terms & Conditions govern all bookings and stays at Lush House (“the Property”), 45 Trinity Street, Barry CF62 7EW. By making a booking, you agree to the terms set out below.
1. Booking & Payment
1.1 A booking is confirmed once the required deposit or full payment has been received and written confirmation has been issued.
1.2 A non-refundable booking deposit of £150 is required at the time of booking, unless otherwise stated in writing.
1.3 The remaining balance must be paid no later than 28 days before arrival.
1.4 If the remaining balance is not paid by the due date, we reserve the right to cancel the booking and retain any sums already paid, subject to these Terms.
2. Cancellations
2.1 All cancellations must be made in writing by email.
2.2 The booking deposit is non-refundable unless we state otherwise in writing.
2.3 If a booking is cancelled within 14 days of arrival, the full balance may remain payable unless we are able to rebook the dates.
2.4 We recommend that guests obtain suitable travel insurance to cover cancellation, illness, travel disruption and other unexpected events.
3. Check-In & Check-Out
3.1 Check-in is from 3:00pm unless otherwise agreed in writing.
3.2 Check-out is by 10:00am unless otherwise agreed in writing.
3.3 Early check-in or late check-out may be available by prior arrangement only and may incur an additional charge.
4. Occupancy
4.1 The maximum occupancy is 5 guests.
4.2 Only guests named on the booking may stay overnight at the Property.
4.3 No parties, events or unauthorised gatherings are permitted.
4.4 We reserve the right to refuse entry or require guests to leave if maximum occupancy is exceeded.
5. Guest Responsibilities
5.1 Guests must treat the Property, its contents and neighbouring properties with care and respect at all times.
5.2 Any damage, breakages, loss or maintenance issues must be reported promptly.
5.3 Guests may be charged for repair, replacement, excessive cleaning, call-out costs or losses caused by breach of these Terms.
5.4 The Property is located in a residential area. Noise must be kept to a respectful level at all times, particularly during evening and night hours.
6. Smoking, Vaping & Pets
6.1 Smoking and vaping are strictly prohibited inside the Property.
6.2 Pets are not permitted at the Property.
6.3 If evidence of smoking, vaping or pets is found, we may charge for any additional cleaning, deodorising, repairs or related losses.
7. CCTV & Security
7.1 For the purposes of safety, security, crime prevention and property protection, external CCTV is in operation at the Property.
7.2 CCTV covers external areas only. It does not monitor bathrooms, bedrooms or internal living spaces.
7.3 By making a booking and attending the Property, guests acknowledge that external CCTV is in operation.

8. Liability
8.1 Guests occupy and use the Property at their own risk.
8.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
8.3 Subject to clause 8.2, we shall not be liable for any loss, damage, injury, delay, cancellation, expense or inconvenience suffered by any guest unless caused by our negligence or breach of legal duty.
8.4 Personal belongings remain the responsibility of the guest at all times.
9. Filming Location Status
Lush House is a private holiday accommodation operating independently. While the Property was featured in the BBC television series Gavin & Stacey, it is not affiliated with, endorsed by, or connected to the BBC or the programme’s producers.
10. Right to Refuse or Terminate Stay
We reserve the right to refuse a booking or terminate a stay without refund where there is a serious breach of these Terms, including where:
- house rules are breached;
- maximum occupancy is exceeded;
- illegal, unsafe or anti-social behaviour occurs;
- smoking, vaping, pets, parties or unauthorised gatherings take place contrary to these Terms.
11. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any dispute arising in connection with them shall be subject to the jurisdiction of the courts of England and Wales.

This Privacy Policy explains how we collect, use, store and protect personal data when you visit our website, make an enquiry, make a booking, or stay at Lush House in Barry.

We rely on the following lawful bases under UK GDPR, depending on the context:
- Contract – where processing is necessary to take steps at your request, make or manage a booking, or provide your stay;

4. CCTV
External CCTV is in operation at the Property for safety, security, crime prevention and property protection. CCTV is limited to external areas and is not used in bathrooms, bedrooms or internal living spaces.
CCTV footage is processed on the basis of our legitimate interests in protecting guests, neighbours, the Property and our business. Footage is only accessed where reasonably necessary and may be shared with insurers, professional advisers, law enforcement or other relevant authorities where justified.
Unless footage is required for an investigation, legal claim or incident review, we aim to retain CCTV footage for no longer than 30 days before deletion or overwrite.
5. Payment Processing
Payments are processed securely through third-party payment providers and booking systems. We do not store full card details on our own servers.
Depending on how you book, your data may be shared with payment processors, booking platform providers, website hosting providers, IT support providers, accountants, insurers, legal advisers, and public authorities where required by law or reasonably necessary to protect our legal rights.
6. Data Retention
We keep personal data only for as long as reasonably necessary for the purposes for which it was collected. In general:
- booking and enquiry records may be kept for up to 7 years to comply with legal, tax and accounting obligations;
- routine enquiry emails that do not result in a booking may be kept for up to 24 months;
- CCTV footage is generally retained for up to 30 days unless required for investigation, dispute resolution or legal proceedings;
- marketing records are kept until consent is withdrawn or the data is no longer needed.
7. Your Rights
Under UK GDPR, you may have the right to request access to your personal data, request correction of inaccurate data, request erasure, restrict processing, object to processing, request data portability in certain circumstances, and withdraw consent where consent is the basis relied upon.
